Under Florida Statutes §61.16, the court may from time to time order one party to pay or contribute to the other party’s attorney fees. This is determined on need of one party and the ability to pay of the other party. The court often considers the party’s respective financial positions and orders one spouse to contribute to the other spouse’s attorney fees.

Your attorney will evaluate your specific situation and the likelihood of an award of attorney fees. It is important to note the award of attorney fees is discretionary and there is no guarantee the court will make any award of attorney fees.

Every case and situation is unique. Your attorney will evaluate your individual situation and advise you how best to proceed regarding these and other issues.
